WCH’s objective continues to be to close our timeshare resort and sell Wave Crest to the highest bidder. Earlier this year, by an overwhelming majority, our Owners approved an amendment to our CC&Rs to prevent a sale prior to 2066. As most of you know, WCH filed a lawsuit, alleging, among other things, that the CC&Rs were improperly amended. The trial court judge summarily dismissed WCH’s entire lawsuit as meritless, upholding the will of the Members and the Board’s actions. Unfortunately, WCH has filed an appeal of the ruling dismissing its case, and continues to pursue the sale of Wave Crest.

This latest action, attempting to remove the current Board, is just another tactic by WCH to divide Owners in pursuit of their financial goal in direct contravention of the CC&Rs. The Board is complying with all Wave Crest governing documents and California statutes. Recalling the Board will add more cost to the Association in order to elect a new board who will have no choice but to continue to comply with Wave Crest’s governing documents.
